Maximum Match Points for Justice

One of the hardest things a lot of people find to understand about False Allegations is what they say about the legal Justice system and how it is functioning.  Often there are calls for new laws of checks to be put in place, or various “lessons to be learnt” when, in truth, the laws we have in the country – the lMatch4aws that are meant to protect each and every one of us – are already in place.  It is understandable to hear people say things like: “well, he must have done something wrong if they have charged him and taken him to court.”

The scariest thing is that unless people have personal experience of false allegations they genuinely don’t know that this is not t he case.  It might be hard to imagine, but people genuinely are arrested, charged and even – in some terrible examples – convicted where there is no more than the testimony of the claimant (the correct term, as opposed to “victim”).  In fact, in many case, and especially when the case is an historical case, there is no evidence that any crime was even committed.  There is no broken window to show the vandalism; no missing car to show the theft; no burning building to show the arson; and no body or huge amount of bloody to show a murder.  There’s nothing.

So people can be facing a trial that not only are they not guilty of, but one that never even happened.  However, it is important to remember that FASO does not deny in any way that abuse does happen.  Quiet the opposite, in fact.  It worries us greatly that whilst the police waste their time entertaining yet another liar’s fantasy. there are other real victims who need their help.

We are supposed to live in a society that shares in a belief that all children should be protected from harm.  But we are also supposed to be able to rely on the idea of being treated as “innocent until PROVEN guilty”.  But in reality…this simply isn’t the case.

So, here’s an image to have some thought over.  Match up the 4 terms with the 4 statements.  Share your thoughts on what it might say not just about the issues of false allegations, but also how they work in hand with child protection.  Remember, FASO believe in the support of ALL genuine victims of these terrible crimes against people of all ages.

Our legal system is supposed to be “innocent” until proven guilty. But the way we still treat those accused of sexual offences – even before there is any evidence at all that they did anything wrong – as “guilty until proven…unprovably guilty”. Because even if the case never gets to court, or if it does and the defendant is acquitted, people still say “no smoke without fire.” More needs to be done to protect the innocence of people until at very least they have been charged with a crime that there is evidence that a crime even happened.

It’s the most horrendous crime to be accused of. With serious implications on people’s lives. There really are no words to describe what it is like, being social outcasts, at risk of losing your children and being dragged through the mud, careers at risk years of study and hard work gone over night. All for a false allegation with no evidence. No arrest but still serious implications from that. Mental health in serious decline so much so my partner as tried to kill himself twice in a month! This is one of the hardest things I have ever had to go through watching the pain and anguish of my partner everyday knowing I cannot do anything. Then being threatened 4 months after the allegation that I’m an inadequate parent. I thought the English justice system was innocent until proven otherwise but it really isn’t the case.

I myself have been falsely accused ,I have set Kerphew and can’t enter my home town just because it is her word against mine ,I’m a support worker and base my entire life around helping people ,each and everyday am out there trying to make people’s life easier whilst mine gets harder because of this charge hanging over me ,I can’t apply for another job until I know that this has gone away ,if it ever does ..I have always been there for those suffering and in need and now I look like one who prays on the suffering ,it’s absolutely discusting and twisted and I can’t believe people can be so filthy by making false accusations ,you ‘the justice system’ corrupt by the idea that the accused is that of a bad person,a horrible person and not even inquiring into the matter that the accuser could be the bad one …I will have to quit my dream of helping people now ,live a depressed state until it’s resolved or if it ever is …thanks a bunch!

I fully agree with this statement. I personally was sent to prison for 5 weeks, not for a sexual abuse accusation, but for a physical abuse accusation. The police found no evidence. Cameras were checked, doctor’s physical tests were made, no eye wiittnesses, the accusers story was not strong and less than cinsistant, but still i went to prison. The trial was a complete joke. The justice system failed me because the police turned the case into something they wanted it to be and not a case based on evidence or facts that could be proven. The law is more concerned about not looking the fool when investigating these sort of cases and finding them to be false rather than protecting the lives of the innocent people whom these liars target for malicious reasons

… i can no longer apply for my dream job as a psychologist because my name has been tainted. It is true in these sort of cases it is always about who to believe. Granted they’re are genuine cases of abuse and i whole heartedly believe that these people deserve justice. I only got 5 weeks in prison because that was all the judge could give me and it was based on my attitude in court not evidential substance

In HSA cases, beyond reasonable doubt has been removed, the accused is presumed guilty, and no evidence is required. It is the word of one person against the other and as the accuser MUST BE BELEIVED, (T MAY) The accused is presumed GUILTY. Unless the accused has the wealth to obtain a professional defence lawyer and private detective then there is no chance. this explains the 000s of innocent people who are sat in cells wrongly convicted of non existent crimes. They are the VICTIMS. Their families are the VICTIMS. It also seems that most of these accusers have been in therapy of some sort. These thoughts seem to be implanted into vulnerable minds, looking for reasons why they are feeling down, by therapists who’s only qualification is 10 weeks training. They are the criminals.

It is such a confusing mess, to be honest Linda. For example, if anyone reads the CPS guidelines on how cases are brought and tested for prosecution they would find a balanced system that not only makes it abundantly clear that the evidence MUST be compelling to ensure a “safe” prosecution, but they also show that it is the duty of the CPS and police to test all evidence regardless of the effect on the prosecution. Therefore, they even state that should a piece of evidence exonerate a suspect then this should be included and used.

And yet, in the real world, the laws we have appear to be entirely ignored when it comes to the charging and even conviction of people who are accused. It is a broken system that sadly, as you say, only those who can afford a defence will get one.

20 years ago I ask a female drug never to sale Es to my 15 year old son, my partner went tn the police she knew through her work as a security manager for the co op, 12 months later she was busted for 4 times drugs with the intent to supply, there was also a gun found which at the end of the interveiw whilst under caution, even though she hadnt seen her for six months, was allowed to say I had tied her granddaughter granddaughter up with rope and assaulted her, the police invit me to the station where im in a one question interview that last one minute, never arrested or fingerprinted, no dna, yet 16 years later I thind out through Sarahs law that a police officer will knock on my girlfriends home and say wot I fought was forgotten, did she now that I was??? Today my business is detroyed ive got a eating disorder, lost three stone in weight and self harm, so lowe has life become I’m considering doing the same to another innocent person just to prove how easy it is to destroy another’s life

I totally agree with you Linda. And too many of these cases are vindictive exes who want to destroy the person who they once loved. While they destroy men and their families’ lives. It is a real shame that they keep on getting away with committing a serious crime. They are wasting State Resources and Tax Payers’ money. We have far too many innocent men spending time in jail for goodness how many years. Their lives destroyed. FALSE ACCUSATION IS A CRIME AND THOSE COMMITTING IT SHOULD BE PUNISHED. I am ashamed of some of my fellow “sisters”.

Some people just don’t care. They are so self-centred it doesn’t matter to them. Many false allegations are a part of custody battles, and the false accusers seem not to have the foresight to consider the sheer damage to their child when they throw false allegations around.

There is a case right now in South Dakota. Ex Husband being accused for raping his 15 yr old daughter. The Mother manipulating her children to lie because she does not have custody of the children and want to get back at her ex. Three children were taken away from the Farther 18 mnths ago and placed in foster care. Father not allowed to have contact with kids at all. The youngest is 5 yrs. Due to the traumatic experience in his life the 5 yr old started spoiling his pants. He is being punished by the foster parents by taking a blanket away from him at night in the cold weather. The Foster parents are only in it for the money. And they want to adopt the kids because it will mean a permanent income for them for several years.
The Daughter admitted that she lied, as well as the Mother. No medical evidence was found that the daughter was in anyway ever violated, and still the authorities kept running with the case. Character witnesses for the defendant was the ex wife’s 1st husband and their son aged 17.
The Father’s went to court on the 18th April 2016 and the Jury found him guilty. After the court case was adjourned someone overheard a Jury Member saying ” he is from South Africa, so F–k him”. (He has been in America for over 18 years.) SO IS THAT ZENAFOBIA STICKING OUT ITS UGLY HEAD ????
The Father was arrested the following day and will stay in jail till the 20 June 2016 when his sentencing hearing will take place. Fortunately there is a Group of Caring Citizens is getting together as we speak to form a plan of action.

Hi Linda, couldn’t agree with you more.
My husband has just been convicted of historical sex abuse (multiple counts) and was guilty from the start although there wasn’t a scrap of evidence against him, only the allegations.
He established a motive for the allegations, which I agreed with, and had four different witnesses, including me and the girls mum, who said they were present when some of the alleged abuse was said to have taken place but they saw nothing! Also his barrister was able to categorically disprove the dates the abuse is said to have taken place but the prosecution were permitted to change the dates which meant all the alleged abuse from over a period of 5 years is now condensed into just 2 months!! Oh and there was so much more that made it doubtful.

With the hard evidence he had to disprove the allegations I felt sure it would not holdup in court but the jury saw it differently!
Then when the court received the “victim impact statement” it still referred to 5 years of abuse!! Nobody told her she needed to amend it! He’s yet to find out if the statement will be used!
It’s all totally biased in favour of the complainant and he’s off to prison soon!

Dear Linda
I’m in total agreement with your comments, I myself have just been through an absolute hell for over 27 Months , after firstly being blackmailed, extorted and my Wife’s life threatened, luckily I’m a person who is able to meet the fight head on and began my own investigation which resulted in my acquittal and proving the accusers had lied throughout. It was no easy battle and one day I will publish my account, this I know, but I sympathise for the poor soles who lose the will to carryon as one must assume the world will find you guilty from the start and its your job to turn the tables. The Police done nothing to assist on my side and believed the accusers , what they and the jury had to believe was the hard evidence we produced during my trial as facts could not be disputed.
FASO where there to help and assist and I dare say without them id have certainly been a lot weaker. My thoughts are with the innocent!

My husband was convicted 2months ago of Historical Sexual Abuse, apparently over a 10 year period. He is currently awaiting sentence in prison and the whole family are devastated by this.Over 100 young people were interviewed by the police and 6 ‘complainers’ came forward to give evidence against him. Why were none of the 96% positive statements ,given by kids in his care over many years, used to exonerate him. We are astounded at the whole process and believe there are many flaws in the so called ‘Justice System’ Which gives many innocent men no chance whatsoeve,r of proving their innocence. I am outraged at this whole system and feel totally helpless in being able to support my husband. I need some help, please!

Hello Liz. I am so sorry that you are now on this horrific journey I too have been thrown into exactly same position. There are many of us, I would say 000s. All without a shred of evidence. It is an emotional roller coaster ride. Personally I feel that if we all stick together and involve our MPs demanding that they help us, we could make a difference. The world has gone mad when we allow our justice system to obtain guilty verdicts on non existent crime. Would love to be in touch.

Are their no legal rights or activists that can fight this? Surely there is enough evidence now to support a law change to force “innocence untill proven guilty”? My family are dealing with this right now! Dad was even intimidated into pleading guilty knowing he was innocent just to have the custodial sentence removed… it’s sick… the law protects only the criminals! Any advice or contacts would be greatly appreciated! x

My ex is manipulating my ten year old who has accused me of something, I don’t know the details. My partner who is 39 weeks pregnant cries all the time. I’m having nightmares and struggle to sleep. The police have sat on this for months and I am really struggling to deal with this. All because I am fighting her for breaching a contact order.

It took 3 years and ten months from the moment I was arrested to the Crown court trial for historical sexual abuse. I had 8 counts to defend myself against. I was found Not guilty on two counts, the remaining 6 counts led to a hung jury. The prosecution demanded a retrial. 8 months later I once again appeared at Crown Court for retrial. The jury found me not guilty on 5 counts out of 6. The prosecution dropped the 6th count and the judge declared a not guilty verdict on all 6 counts. 4 months later I applied for a an Enhanced DBS check in order as a dance teacher to continue to teach children. I had two make two representations via my solicitor to the local police as they fully intended to put on the face of the certificate every single accusation made against me even though after Two separate Trials, Two separate Judges and two separate Juries finaly declared a NOT GUILTY verdict on every single accusation. I am now in receipt of my Enhanced DBS certificate, and as threatened every single detail was on the certificate. It has now gone before an Independent Monitor in hope they will remove this. My entire life as a dance teacher and my dance school was destroyed, after 40 years of being a highly qualified dance teacher. In the eyes of my local police authority I am Guilty until Proven Guilty. They issued an Enhanced DBS certificate declaring I was safe to work with children and venerable adults and yet in TOTAL contradiction anyone reading the contents of accusations would never ever in their lifetime allow me to teach their children
GUILTY UNTIL PROVEN GUILTY is the opinion of my local police authority. THERE IS NO SUCH THING AS INNOCENT UNTIL PROVEN GUILTY.
